1. HOW TO USE THE WEB PAGE
Use of the web page is limited to private use and commercial exploitation will not be tolerated. Users do not have the right to make copies of the web page or parts of it, nor to present, publish, exhibit or change the web page, nor create a web page based on the same without the express permission of Open House Spain S.L. The right to use the web page, to look for information or realize a reservation is only granted to people older than 18 years of age, individuals, legal entities, or representatives of institutions or companies. We reserve the right to change the web page or parts of it and its contents whenever we consider necessary. Although we utilize all our efforts to assure the exactitude of the information provided on the web page, it contains informational material provided by third persons and/or institutions. Thus we do not take responsibility for this information.
2. RESERVATIONS
Open House Spain S.L. only accepts requests to reserve accommodations through the correctly filled out and mailed form on the web page. All questions regarding confirmations, services or cancellations must be done in writing via electronic mail or fax. By completing the reservation request, the web page user decides to conclude a contract according to these conditions of use and will be considered a client as of this moment. Once the confirmation of the reservation is mailed by electronic mail, fax or regular mail, a valid contract will be realized. The client must verify that all the data in the confirmation is correct and notify possible corrections to Open House Spain S.L. within three days. If the client does not notify changes within this period, the client therefore accepts the reservation as completed. We reserve the right to correct errors based on calculations or spelling. The client responds jointly and severally to all the obligations that may proceed the contract, and is responsible for all the people who accompany him/her and who are included in their reservation.
Accommodations (hotels and other lodgings):
The availability of the accommodations is updated constantly, day and night, 365 days a year. Notwithstanding, if the user sends a reservation request to Open House Spain S.L. to reserve a lodging that is not available, we will inform the user immediately, including possible equivalent or alternative accommodations. If the user decides not to accept any of the alternative accommodations, all personal data, as well as the credit card information will be erased immediately. Possible bank transferences will be returned.
3. CREDIT CARD AND SECURITY
Open House Spain S.L. takes every possible precaution to protect the information of the web page users. The personal information of the users will be protected on line as well as in our offices. When the client enters personal information to the form (such as a credit card number), this information this coded and protected with the best software on the market - SSL and PGP. A safe page, like our forms to reserve hotels, lodgings or courses, carry the icon of the closed padlock on the navigator, like Netscape or Microsoft Internet Explorer, while on other pages where the user is only navigating, the padlock remains open. While we use SSL software to protect personal information on line and PGP to protect it during data transmission, we also do everything in our power to protect the user's information offline. The use of all information concerning users, not only personal information, is restricted to our offices, property owners and/or partner Tour Operators. All employees are informed about our Privacy Policy. If a payment is made using the automatic payment system, the card details are processed by www.bibit.com, Global Payment Services or Interhome, our partner Tour Operator.

4. FORCE MAJEUR
The client is not released from the responsibility of payment due to personal circumstances or force majeur such as war, strikes or natural catastrophes.
5. BEFORE AND DURING THE STAY
Open House Spain S.L. can in no way be responsible for possible damages and/or losses resulting from the journey to/from the destination. The user is entirely responsible for necessary documents in the country they are visiting, as well as all required vaccinations if needed.
6. DOMESTIC ANIMALS
Domestic animals are not usually permitted in the accommodations. In certain cases, (guide dogs etc.) it is possible that the owners/hotels give special permission. It is necessary that the user has consent in writing from the proprietor of the lodging/reserved hotel in order to bring the animal.
7. PRIVACY POLICY
Open House Spain S.L. wants to demonstrate its persistence in preserving your privacy. If you are interested in inquiring about the collection and use of personal information, who and how we gather the information as well as with whom it will be shared, please consult our Privacy Policy.
8. CLAIMS
In the occurrence of a claim referring to a lodging, the user must go directly to the reception or person in charge of the hotel or the contact person for the reserved lodging, allowing them to take the correct measures to resolve the situation. Open House Spain S.L. can not be considered responsible for possible losses or damages caused by acts, omissions or negligences of third parties or a supplier. In case the hotel or lodging does not take the necessary measures in a reasonable period of time to resolve the reason for the claim, the user must contact Open House Spain, S.L. to find an acceptable alternative, in good will, within the limits of the possibilities and limited by the amount paid for the reservation. Once the stay is finalized, the user will not be able to demand any compensation after not having processed the claim during the stay.
The user agrees not to take legal action against Open House Spain, S.L., its suppliers or their respective employees or agents. This clause is valid regardless of the claim, action, demand, aim, damage or cost including but not limited to legal fines or penalties for which the user and his companions may be responsible for the before-mentioned responsibility, or any third party resulting by free will annulment or by not respecting any law or third party right or use of this web page.
Open House Spain S.L. is unable to accept responsibility for the disruption of the water supply to any property when due to the implementation of water-saving measures taken by any local governing bodies. In the event of such actions, Open House Spain S.L. will do everything possible to inform clients in advance of the rental period.
Low Price Guarantee
The minimum price guarantee is applied solely if all the following detailed conditions are respected:
The user has confirmed and paid the reservation for a lodging with a web page of Open House Spain within a maximum time period of 24h. Last minute reservations and special offers do not apply. The conditions of the lowest price offer found by the user are identical to those of the reservation confirmation with Open House Spain (Same dates for the stay. Same number of people. For hotel reservations: same hotel, same room and board types. For apartment reservations: same apartment). Offer is based on real availability at the time of the reservation (Open House Spain does not accept claims based on offers that do not have real availability for the dates of the trip). Open House Spain only accepts a claim if the user has confirmed and paid the reservation with Open House Spain and it has not been annulled. The reimbursement never takes place until after the stay is completed. Open House Spain only can accept claims referring to public prices. Special prices for offers, promotions, last minute, groups, employees, members of clubs, etc. cannot be considered).
Claims should be sent through email to the contact provided in the reservation confirmation within 24 hours after having realized the reservation. Claims that do not indicate with clarity where the better offer can be found or if we cannot verify the claim, the low price guarantee cannot be applied.
9. RESPONSIBILITY
Open House Spain S.L. is an intermediary service for hotels, lodgings and Spanish courses. Therefore Open House Spain S.L. can never be responsible for delays, accidents, losses, program and tariff changes, damages, etc. that may occur during one of the contracted services (for people or objects).
Open House Spain S.L. is never responsible for the following:
- Errors, omissions or words with incorrect spelling
- Falsification by third parties, proprietors or language schools.
- Damages and personal injuries which may occur during the stay at the lodgings and/or language schools contracted by Open House Spain S.L.
- Discussions between a client and a third party
- Content of the web page accessed through links found on this web page.
The service of Open House Spain S.L. is completed after the preparation and the emission of reservation documents. This can be by electronic mail, fax, personally in the offices of Open House Spain S.L. or by mail if the client wishes. In this last case, Open House Spain S.L. reserves the right to charge a supplement of 25 Euros.
Open House Spain S.L. is responsible for the preparation, diligent supervision and the careful selection of service suppliers and the contribution of services agreed upon with consideration for local and national standards. The responsibility of Open House Spain S.L. is excluded or limited to the value of the completed reservation. Open House Spain S.L. does everything possible to verify and update all the information published on the web page, but Open House Spain S.L. is never held responsible for its content. The responsibility of Open House Spain S.L. is limited in all cases to the total amount of the contracted services. OPEN HOUSE SPAIN is not responsible in any way for the acts, omissions or negligence of their suppliers, or for any damage or cost resulting from the before mentioned situations. In addition, OPEN HOUSE SPAIN and their suppliers are not responsible for reimbursement in the case of overbooking, force majeur or any other cause beyond their control.

10. TERMINATION BY OPEN HOUSE SPAIN S.L.
Open House Spain S.L. can terminate a contract without any consequence, if, independent of warnings from Open House Spain S.L., the client causes permanent nuisances during the stay or he/she behaves contrary to the conditions of the agreement to such a degree that the immediate termination of the contract is justified. If such a situation occurs, our demand for the total rental sum is still in effect. Nevertheless we must consider the value of saved expenses as well as the possible advantages if we secure another reservation for the lodging for the same period.
11. NOTES
Any official notice sent to Open House Spain S.L. must be sent to sales@oh-barcelona.com or the fax number +34 93 467 37 62 (Spain). As a client you must inform Open House Spain S.L. of any possible changes such as the expiration date for a credit card used to make a reservation, change of address, etc.
12. CLAUSES
In case one of the paragraphs in this agreement is declared illegal by the court, this will not affect the validity of other paragraphs. If a rule loses its validity in only one section of this agreement, the other sections maintain their validity. The condition judged invalid or inapplicable can be replaced by another of valid form, as long as it has the same meaning. Any conflict will be governed by the law and the non-exclusive jurisdiction by the Spanish courts.
13. JURISDICTION AREA
As an exclusive jurisdiction area for lawsuits against Open House Spain SL. Barcelona is in accordance.
14. THE REGISTRY
Open House Spain S.L. and other graphs, logos, and names that appear on the web page are registered trade names of Open House Spain S.L. or its respective suppliers. These registered trade names cannot be used for any product or service that is not offered by Open House Spain S.L. or its respective suppliers, and/or in any way that may cause confusion between clients, and/or in any way that the company Open House Spain S.L. dislikes or discredits.
